Debt Already Settled but Different Collector Wants to Collect - Sample Letter

You have already paid your debt in full. You’re feeling so much better that a debt has been settled. Unfortunately, you soon start to get communication and phone calls from a different debt collector demanding payment on the debt that you have already settled.

Well, you are not alone. Very often, people get phone calls from debt collectors demanding payment on debt accounts that have already been settled (paid less than the full balance) months or years ago. If these type of debt collectors start bugging you, then you should send them a letter that shows that the debt has already been settled.

Below is a sample letter that informs debt collectors that “debt is already settled” and a request for them to stop any future collection action.  Please also feel free to copy and paste this sample letter in your favorite word processor or text editor, then tweak and edit it to suit your exact situation.

Dear Mr./Ms. {Collector’s Name of name of Collection Agency}

This letter is to inform you that the account in question was settled on [insert date] with [insert name of collection agency]. I have enclosed copies of the settlement letter and proof of payment. You now have proof that this debt is no longer collectable, therefore I demand that you remove this account, and all references to my personal information, from your records.

I do not expect to hear from you again regarding this matter however, should you choose to ignore this notification, I will consider any contact not in accordance with the Fair Debt Collection Act, a serious violation of the law and will immediately report any violations to my State Attorney General and to the Federal Trade Commission and, should it become necessary, take legal action to protect my myself.

    I have similar situation but i didnt pay the equity loan but it was included in the short sale of my house last year. In my credit report it shows as written off, but the bank/collection agency still keep sending me collection letters threatening judgement and such. if the loan is written off, why are they still trying to collect and bugging me. i am unemployed.
